PORAC and LDF are very much aware of the recent vaccine mandates being issued in many jurisdictions, ranging from a mixed mandate (with regular testing as an alternative) to outright full mandatory vaccinations for law enforcement.
PORAC Legal Defense Fund, as the largest and most prominent legal fund for public safety personnel, realizes that it has an obligation to proactively delve into these issues on behalf of the more than 140,000 members across the nation. Recognizing the sensitive and personal issues that come from a decision to be vaccinated, we reached out to our experienced and knowledgeable panel attorneys to advise us, and you, on the current state of the law in order to determine whether PORAC and LDF could launch a successful legal challenge to these mandates. As you can see from the attached legal position letter our attorneys have collectively prepared, they are of the unanimous opinion that our options are extremely limited and any fight is quite unlikely to be successful.
While the LDF Board of Trustees will not address this issue until an appeal comes before it, we want you to know that the LDF Plan Document sets forth several exclusions which will likely preclude LDF coverage to fight an administrative separation from employment arising from a refusal to be vaccinated. |
